Gift of property sister who is married

Dear all,

Can a gift deed be registered for immovable property, which is gifted between sisters ( Both are twins). When I enquired with sub-registered office in Chennai, they said it cannot be done and we have to pay full stamp duty as per guideline value.
But for gift the stamp duty is only Rs.10,000/-. Can any one advice me on this issue.

stamp duty on gift deed would depend upon state where you are located . each state has its own gift tax



As per the provisions of Bombay Stamp Act, 1958,



In case the donor and the donee are blood relatives like brother, sister, father-son, mother-son, husband and wife, then the stamp duty at rate of 2% of the market value has to be paid a stamp duty.

Stamp duty on gift deed is differ from state to state.

Yes ! stamps duties are matters of states.

Generally the stamp duty between the family relations like brothers and sisters attract lesser amount.
