Noc granted

Respected Sir,

One of the flat owners of our society was granted an NOC in the year 2003 by me. Now there are claims of property tax and ground rent on that flat from 1990 to 2003 and the new owner of the flat is claiming that money from me.

Please guide as i had given the NOC for only maintenance charges.

Please assist.

Sir i was the secretary then .The NOC was granted in good faith so that the buyer could complete its formalities and the buyer also had the full knowledge of it then and thanks for your promt response

how did you as secretary grant an NOC when property tax dues were not paid and other dues were payable .?

genrally for grant of NOC we cross check that there is no outstanding dues payable . the maintenance bills include property tax bills raised by muncipial corporation .


in any case the agreement entered into between seller and purchaser contains a clause that seller will be responisble if any claims are made and he agrees to indemnify the buyer .
he can recover it from seller .

You ask the buyer to claim the same from seller as you are not liable to reimburse.
