Revenue authorities are not issuing legal heir certificate,they are issuing only family members certificate,there is no need to file legal heir certificate for partition suit. However the plaintiff should prove him or her self the successor of the deceased.

no, it is not required. a legal heir of deceased died with out will can file partition suit without any certificate of heirship. however, he has to gibe specific description/assertion in this regard in the plaint.
