a police rebuked me

(Querist) 29 July 2010 This query is : Resolved 
A police officer of rank SI rebuked me and used indecent words in front of my parents in my absence. During this incident, i was in chennai. so, i send notice to the SI through a lawyer. But he refused to receive it.

I am studying LLB 2nd year.

How to file a criminal case against him?
pls guide me

File a case u/s 156(3) bringing charges under section 504,506 of IPC.But instead of doing that it is better to lodge a complaint to his higher authority.

You cannot file a criminal case against the SI unless the state government grants permission for you to prosecute him. It is better to complain to his higher authorities and if you are particular about prosecuting, you need to have solid proof of your accusation and then apply under Section 197 of Cr. P. C. for grant of permission. After obtaining permission, you may file a case against him.
