Child custody issue, permanent alimony and maintenance, streedhan, joint property issue all are included in divorce by mutual consent joint petition to be filled by both parties. You should specifically mention each and every terms and conditions agreed by both parties so that the comprehensive petition becomes part and parcel of the divorce judgment and decree.

Settle all terms and conditions of Divorce in a single agreement. Once both the parties agree on the point of custody of child, there is no need to go for any separate litigation.
