Sir/Madam there is an area of near about 5Acr attached to my property which is a Debottara Land and the kisam is Jungle 2.Can i take it on lease for maximum periods

In accordance with Indian Law any property dedicated to Hindu Religious or Charitable purpose is called " Debutter Property ". .. A Debutter is an Endowment much less a Trust although it can be created through the medium of Trust in which the property vests in the Trustees and the Deity / God would be the beneficiary. Not necessary the Debutter is always a Registered Deed. For your requirement discuss with a local good Civil Side Advocate and obtain his Legal Opinion and Proceed Please.

1. Reserved category or Specified category of Land CANNOT be Sold /Leased /Gifted /Mortgaged /whatever .... without the written order of the district collector.

Yes, you can take the said land on lease subject to the compliance of the relevant rules by the lessor.

Any property absolutely dedicated to Hindu religious or charitable purpose is called Debutter Property. Debutter means literally belonging to a deity. The person who manages the debutter property is known as the Shebait in Bengal, Dharmakarta in Tamilnadu and Andhra Pradesh, and Panchayatdar in Tanjore and Malabar.
In Shyamal Ranjan Mukerjee Son Of … vs Nirmal Ranjan Mukerjee WRIT – C No. – 56447 of 2003 [2007] INUPHC 14725, it has been held that: “Property dedicated to and vested in Deity is unalienable if there is restriction in the Deed of Dedication and any alienation made in contravention of such restriction is not binding on the Deity.” In Shyamal Ranjan Mukerjee Son Of … vs Nirmal Ranjan Mukerjee WRIT – C No. – 56447 of 2003 [2007] INUPHC 14725, wherein it has been held that properties vested in Deity may be alienable in the event of legal necessity with the prior permission of the concerned District Judge.
