Sir/mam kindly give your valuable opinion,In the case accused was charged with some anti corruption act while under his service and at the very moment of cross examination of complainant he died and cross examination never happened but in lower court the case goes against the accused with termination from his job now he is filling case again in high court so could he get the benefit of cross examination that never happen(during C.B.I rate cbi does'nt found anything from home or any property it all was a part of conspiracy)

C.B.I had never prooved that any kind of property,bribery was taken even though there was a never a single complaint against my father,but when the rate was to be happen complainant called my father and ask him to take labour payment and at the very moment c.b.i take the money and filled the case, complanant died before cross examination but lower court had given against my father.Now he is appealing in h.c so i just want to know that do the h.c decision could go in favour of my father...do give your kind advice or opinion or suggestion.

Depends upon evidence collected during investigation by the police, not merely on complaint.
You may better discuss complete details background of the case along with the charge leveled by the CBI. It would be much better, if you show all the case related documents to some service laws expert for detailed examination and appropriate guidance. Sorry sir i dont have scanned copies but i can tell you that there is a matter and dispute related to payment of labour complainant was a contractor and at the time of some work payment he did not give payment to them and labour asked my father bacause he is s.d.o at that time my father asked him for labour payment but he asked my father to come at some place where c.b.i team was already there and at the time he give money they charged my father with corruption charges..this case was of year 2003..sir could you tell me something else and thank you sir for your valuable suggestion.

You may better discuss the matter with the lawyer of your father. Without examination of the case, no opinion can be formed on casual type of description. Corruption related problems are not so simple to expect solution by casual discussion.
