partition suite is pending in the court,the share of 6 acres has to divide into 3,it is a ancestral property,last brother is prolonging the case,renaming 2 brothers health is not in good condition ,one is 80yrs,and another is 79yrs ,one is under dialysis treatment past from 2yrs,kindly advise,if the will done for ancestral property equall share to all ,the 6acers of land is in the name of elder brother who is 80yrs he his ready to do the will,kindly do the needfull

How has elder one acquired title in his name ? Ancestral property will devolve upon all descents even without Will. Both the elders may be having their children, who would enherit without any extra benefit to the youngest;

The author should understand the meaning of ancestral property. Just like that if the grandfather' property was transferred by the grandmother to her son, will not become ancestral property to the grandchild, Therefore do not supply piece meal information, better come out with the details if you want proper opinion or go ahead with the pending litigation through court itself.

Dear sir
my grand father,had 3sons and 2daughters,after grand papas death property transfered to his elder son still today the whole property is in elder sons name.
grand fathers childern name 1)hanumappa,,2)ramappa,,,3)nagappa,4)halamma,5)gangamma,3sons,and 2daughters,daughter died 40yrs back.
ramappa left the village in 1968 as he got the govt job,after couple of days, elder son hanumappa also left the village for some reason,till today ramappa and hanumappa never visited the vilage,
now 2yrs back ramappa has filed a partition suite in court,the last son says now the partition has taken in the yr 1985 to ramappa,hanumappa,and 2 daughters it is a false allegation and they have no records,only we have pani record of 6 acers which is in the name of hanumappa elders son,my lawyer says it is a false allegation by nagappa.

This seems to be grandfather's self acquired property who died intestate, therefore the property will devolve on all his legal heirs. The grandchildren cannot claim any share in it as a right.

If grand father acquired from his parents, then it can be ancestral; So facts have to be spelt out !

grand father purchased by his own money,will his sons will get equal share.
the last son MR NAGAPPA SAYS PARTITION HAS DONE 30yrs back which has no documents,false telling in court.
the entire property his in elder son name Mr hanumappa,we didnt get any papers expect the (pani) RTC.
