Summary suit v/s recovery suit

i have taken loan from NBFC for which i was unable to pay the ECS since last 2 yrs during the period i hv paid some amount like 4 emi in cash my loan is unsecured loan. nbfc have filed 138 complaint against me and now they are filling recovery suit also at one of their clause they have mentioned in the plaint like under order 37 and else where mentioned civil recovery suit please tell me what will be worst sinerion in this case?

WORST FOR ACCUSED OF 138 N I [ CRIMINAL]
CAN BE JAILED + PAY COMPENSATION+ IN CIVIL SUIT FOR RECOVERY..

in summary suit NBFC will get decree for principal amount plus interest . in 138 NI case you can be convicted sent to jail and asked to pay compensation to complainant

In 138 NI Act case, person can be convicted, in recovery suit case can be decreed. Agree with the experts.

Please comment on recovery suit and summary suit it is correct Mr. shroff that i have query of 138 and civil suit. i am a law officer and non practicing advocate so we need opinions from you experts. But if i ask for the same many of you denied to provide. share yr knowledge .

WE avoid reply to commercial query, where querist want to use it for profit generting, free of cost.. you can afford Lawyers fee, and avail their services.. WHY LOOK FOR FREE CHARITY TO EARN ...
