Slp in apex court

(Querist) 27 May 2015 This query is : Resolved
As you are aware it is vacation time now. I had filed SLP against Division Bench Order rejecting early hearing application.
The case is registered and I am waiting for listing.

If the SLP is granted, whether fresh appeal has to be filed? I am petitioner-in-person.
Ld. experts please guide.
Anirudh (Expert) 27 May 2015
Either of the two things is likely to happen on your SLP. In both the cases, the SLP will get disposed of on the first hearing itself.

(1) SLP will be disposed by directing the HC to consider early hearing of your case.

(2) SLP will be dismissed as not calling for any interference by the Supreme Court.

In either of the case, you need not have to file any fresh appeal at all.

Assuming that the SLP gets admitted, then the SLP itself will be treated as Civil Appeal and a Civil Appeal No. will be assigned in the place of SLP No. That is all. Nothing more.

I agree with experts advise, nothing more to add.
In neither of the situation you need to file afresh.
