Religion and surname of child

Hi. Can anyone please explain and provide a solution to my query. I am a hindu girl about to be married to a muslim boy. His mother is a muslim and father is a hindu. However he has recently changed his name and surname to muslim one. Can our child have my surname and religion( i am not willing to change) if the father of the child has agreed to give my surname to child. Please help.

The child gets the religion and surname of his father.
So if you want your child to be Hindu then you will have t convert him to Hinduism and accordingly give new name and surname with consent of your husband.

Hi. Thank you so much. Here the father has recently changed his surname to a muslim. And is willing to have children as per hindu surname and religion. So is there any kind of documentation requirement for the same for the child? Please do help

There is no as to name or surname. A person need to have a name which is his choice. It is not at all necessary that a person should have a surname.

Religion is also a matter of personal choice.

You can choose Hindu or Muslim name for your children.

Actual religion would be based on father.

Islamic law does not recognize inter religious marriages. Both parties should be Muslims. As u do not want to convert urself to Islam, u will have to get ur marriage registered under the Special Marriage Act. The Act is silent on the issue raised by you. But the children will take the religion and surname of the father. Surname being the family name it cannot be changed. As regards personal name, both urself and ur husband may decide to give a name, of ur choice but the surname cannot be changed. Shahrukh Khan married Ms. Gauri who has not converted herself to Islam. She is after marriage called as Gauri Khan and their children are given pure muslim names. Do not confuse the religious status of ur progeny.

It may be that Guri Khan is using her husband's surname. It is her personal choice. There is law, not even a custom having the force of law, which mandates that a person should have a surname and it should be that of the father or the husband.

Academic query.

However, you can feel free to use your own surname and also even both of the mother and father of your husband. You can eve name your child with a christian name. So, what is in the name. It is just for giving him/her some identity.
