Regarding property will

(Querist) 20 November 2014 This query is : Resolved
My mother wanted to get her property will done and I had gone through an article where they specified the requirement of will and creating a will and registering it.

Now, I want to know if I want to get this done through lawyer then how much he/she would be charging. Is there any fixed cost or percentage or it depends on the property value?

Also, will the lawyer only get it registered and is there anything else i should keep in mind.

Lawyers' fees like DOCTORS always varies from person to person.

Sir,

Services of a Lawyer are not necessarily required to draw a WILL. A WILL can be written on a full scape paper, advisbly by the testator himself/herself.

The essentials are [1]Appointment of an executor of the WILL,[2] two independent witnesses in whose presence the WILL is to be signed by the testator, appointed excutor or any beneficiary under the WILL can not be a witness.

It is not necessary to get the WILL registered.

Good Luck,

It is true, anybody can write anything oneself - whether it is Agreement, Court cases, WILL etc.

The question to be considered is whether such self-prepared documents without the help of a legally trained mind, will stand the test of judicial examination in future, in case any problem arises?

Lawyers fee varies from person to person. You can inquire locally.

Thanks all for reply and help. I had already read different articles regarding the preparation of will and so i finally decided I should make this through lawyer.

But I still have one question in mind.

Is this fees of lawyer is a percentage of property value? and if yes then is there any tentative idea.

I know it varies from person to person but there should be some standard market rate.
Devajyoti Barman (Expert) 22 November 2014
For Will the fees generally is not based on value of property. It is lump sum and should not cross Rs.10,000/-.

Don't repeat the same question despite being advised very properly by experts. There is no market rate sort of a thing related to advocate fees. It will depend on the lawyer you approach, his standing, expertise and other relevant issues.
