Partner ship frim

We are running a partnership firm with 2 partners and one partner is absent without any information since 3 months and separately there is a civil suite pending between the partners in regard to the property in which the partner ship firm is doing business,Dispute is about the title of the property as it was gifted to one of the partners (all are her sons)
How to dissolve this partner ship and retire the absentee partner

The partners in agreement can dissolve the firm or any of the partners can apply for dissolution of firm.

For dissolution of the partnership refer the provisions of partnership deed.

Regarding dissolution of Partnership firm, as suggested by Experts above you have to refer to the clauses of Partnership Deed which prescribes the mode of dissolution. In case , your Partnership does not contain specific provision on the subject, the provisions laid down under the Indian Partnership Act shall prevail.

Any of the partners can also apply for the dissolution of partnership as per the provisions of the Act.

Depends where the the Deed was originally registered. If you refer to the Deed in question , you can easily find out where it was registered.It may be at office of the Inspector General of Registration (i.e. Registrar of Firms)of your state/ local Sub- registrar's office / Notary Public of your area.It is always advisable to get the registration and amendment to Deed registered with the Registrar of Firms

partner ship is registered in Delhi with Registar-V mehrauli, to whom we should approach for dissoloution as other partner is absent fromlast three and will not sigh the dissolution willingly
