I believe it may not be academic query the author has neither consulted society constitution nor stated facts here so none can advise suitably.

I go with the views of experts above. The author may visit the constitution of the society if he is really interested in knowing the answer for his query.

Dear Experts,
My querry is not acedamic. In our housing Society the previous secretary has held the post of Secretary more than 15 years. When the New committee was elected he wanted to get selected as Treasurer.Another committee menber Objected and said that he can not getElected/selected as an office Bearer(a designated post) as he has already remained as secretary for more than 10 years. He referred to Co op societies act 1960 .It is not mentioned in the model bye-laws which our society adopted. But the act mentions it.(Co op societies Act 1960,Section 73 A5).My query is even though it is not mentioned in the bye-Laws but is mentioned in the Act.Which one to follow?
