Hi,

Seniors, I want to take one suggestion from you.

One of my friend is the owner of One reputed GYM/health club in Delhi.
He have some photos with Bollywood Stars in the parties or etc.
All are photos are personal in nature.

My Query is, can he show legally these pictures on the website for promotion of the GYM and can take commercial benefit legally??

As these pics are not patented or copyrighted. As per my thinking, He can show on website as Mr. Owner is with Mr./Miss. Bollywood Star during the party.

Can bollywood star can take any legal action?

Generally, we also post our pics with friends or celebrities on social sites, on that basis i think he also can post on website (also he is the proprietor).

Please give some light on this.

Using the photographs for commercial purpose can result in legal action if the same is without consent. If such celebrities notice the same.

But it's very unlikely since in this case your friend has mentioned in the captions like 'with so and so in so and so party'. That cannot be termed as a commercial activity.

If he uses it for commercial purpose, the person (celebrity) appearing in that photo can take legal action against him.

look, It's very tough work to get permission from celebrities. And showing that pictures on website (as mr. owner is with mr. celebrity) can make brand value as well as help in earning more money.

So, help me out in this case.

1-In a private party and activities of a person/celebrity can not published with out his /her consent and can not be used and can not used for any commercial purpose!

2-If Your Friend is owning- such reputed GYM -invite such celebrity to his Business place /GYM and with consent of such celebrity take photos in his GYM and with consent to publish in your friends Website ! This may not lead to problems!

obtain permission from celebrities and then use the said pictures in gym . since he is owner of reputed gym pay the celebrities for using the pictures for commercial purposes
