Marriage

(Querist) 27 November 2014 This query is : Resolved 
my wife is a witness in a case, lodged by me against my in-laws U/s 365,366 IPC. But she go for her parents and given 164 CrPC statement against me. Now the case is in court for trial.

Now I want to convert my wife as accused and want to make her as accused U/s 494 IPC. Can i do so?

My legal counsel advice that, we have to file a separate case against her and her 2nd husband U/S 494, 497, 406 & 420 IPC. Is it?

We got married before 3 years under Spl. Marriage Act. now she want to cancel the marriage on a false ground that, her consent was taken by force. Can it possible?

If you want to charge your wife u/s 494 IPC, it is better you file a separate case so that the base case does not becomes weak and this 494 is overseen or goes off lightly.
