I have affair with a married lady who is fighting for her 9 years son's custody and divorce in legal field...child's father is not giving child's maintenance currently...both of us are working in a private segment ....job is not secured for us....the lady wants to run her textile business along with her job and maintain herself and her son...i am a bachelor and decided to drive out the life with her and her son .....in this status can we go for a legal agreement for live in relationship...for live together....

In this status you can only jail upto 5 years as and when her husband files a case of adultery when he gets proof of your relation.

before divorce of that lady, you can not go legally any type of live in relationship. If you maintain any type live in relationship, it is illegal.

agreeing with Mr RK Nanda I will add that there can be a written agreement to commit a crime (as adultery you are planning)and this will be good evidence against you and will facilitate easy abode in Jail upto 5 years.

Be enlightened that the actual jails are not as rosy as shown in movies.

Live in relationship in India is very much valid and recognised in law but the couple will have to be unmarried or divorced.

Well Advised and Agree with Senior Expert Mr.V.R.Shroff.Also there are chances of Visiting Central Prison for Adultery.

agreeing with Mr NJS Rajkumar I will add that it could be even distt jail or sub-jail which is still worse.

The jails in actual practice are not so well managed and clean as shown in movies.
