Is victim just a mute spectator in state cases?

On my police complaint on 3 persons, a case was registered by police over 2 years back.

Accused have taken bail and although one of condition of the bail is to remain present, most of the time they don't appear. The public prosecutor is also not taking any objections or sufficient interest in the case (in fact 3 PPs have been changed in last two years).

When I requested court to look into this, court ask me not to speak in this matter as this the state case. Court even asked me that you are not required to be in court.

Is it fair? I am the victim and I can see that accused are abusing the process of law and despite of that I can not object.

What are my options?

You should engage a lawyer who shall take interest in the case. The contention of the court is correct that being a State case, the complainant is not allowed to intervene in the day to day proceedings of the case and only PP is authorized to represent State. If you engage the lawyer then though he shall assist the PP but shall definitely make a pressure over the court to ensure the due process at the earliest. Accused can apply for the exemption in the presence on the basis of specific reasons if court allows his application. Satisfaction of the Court is the core issue.

What's the point in engaging lawyer when he or she also can't speak in court. Also, most good lawyers wouldn't be interested in attending case where they have no roles, I am sure you would understand better.

So keeping that aside, can something be done so that at least court takes tough stand on accused to atleast present?

complainant himself can keep watch.

Discuss the matter with your lawyer before hand, and watch your interest.

Your lawyer is there to defend you.
