Framing of charge by district court

This case pertains to a death by medical negligence on 14/12/2004. The query is the district court Kollam while proceeding with the petitioners request to discharge them from I.P.C. 304, failed to frame the charge of I.P.C. 304 A while he sent the order to the J.F.M.C. Karunagapally. Now the petitioners have moved the High Court of Kerala to quash the proceedings against them and the H.C. Judge is seeing the ABSENCE of framing of charge as a fatal flaw. I like to know whether there is any way the flaw can be rectified at this stage.

The court must have framed the charges or discharged the accused persons.
Be clear on this issue.
