Facebook photo harassment.

(Querist) 25 April 2014 This query is : Resolved
Question 1: Is there any law to protect my photos from being posted publicly on facebook group? Not being removed even after repeated requests? These are posted by ex collegues with whom I am not in contact. I do not like my photos on facebook because they can be misused. I want an apology with undertaking of all responaibility of any reproduction for posting my photographs. Some were to show me in bad light but had no obscenity.

Question 2: Can I get their addresses by issuing legal notice to the company? the company obviously has mandatory records to maintain and also it cannot obstruct justice. I quit that company more than a year ago and have no contact with these people posting my photos. In fact they are not even on my Facebook Friend List. I myself do not post any of my photos online for security concerns.

Question 3: What other legal actions can I take?
Devajyoti Barman (Expert) 25 April 2014
1. If yur photos were innocuously posted with no pun intended then you have no case. Your apprehensions are misdirected. There are millions of friendly photos are posted in FB and hardly are used or removed on apprehension of getting misused.

2.You better send them request to remove the photos where your picture is depicting. This is easiest way to solve your concern.

3. Do not build a hill out of mole.No legal action is warranted for your concern only.

You will have to take stay order against the persons who posted photographs and also the facebook for removal of your photos.

I agree with the appropriate and useful advise given by expert Mr. Barman on the subject.

Thank you Mr.Dhingra. Now Mr. Barman, with all due respect, please read my question again.
1. Why would a woman consider legal action for innocent photographs?
2. As I wrote earlier, I sent them removal requests already. None of the requests were complied with.
3. With all due respect, you have put across a very good proverb but I am not some magician nor a lawyer to make a hill out of a mole. If a woman is thinking or considering legal action then there must be a reason for it. Its common sense. Could be a divorce case that is getting affected or somethig like that.

You can send a notice to the Facebook Admin to remove those photographs.

If they dont remove it, you can get a stay from the court.

If you feel that your divorce case is getting affected because of this, you can get a stay from that court itself, if you have a strong grounds to convince the court.

I still find no merit in your query.
Vrinda (Querist) 28 April 2014
Arunagiri Sir,

How to send a notice to facebook admin? Also to which address should that notice be sent to? The admin was my collegue 3 years back. The company we worked for may have his address. We have no common link and I hardly knew them for 8 months as collegues that too 3 years back. Can I send notice to company asking the facebook admin's address?
Vrinda (Querist) 28 April 2014
Barman,
Does'nt matter if YOU dont see any merit. You can live with your assumptions. Some good lawyers on this website who attended classes and read law books seriously are there to help.
Devajyoti Barman (Expert) 29 April 2014
your reply makes it clear why are you acting in so maniacal manner.
Vrinda (Querist) 03 May 2014
Mr. Barman, you prove me right again. Your replies make it clear that you are unaware of the subject Professional Ethics.

I have provided you the solution and address. Hope your query is resolved if yes, We may treat this query as resolved and closed.

As per Your Title What is the Harassment. If your photo is in face book it is your job to find out whom you had allowed to take photo or to whom you had circulated the same.If any clue is there you can complain to Cyber Crime.Absolutely there is NO MERIT in your query and I would have accepted if you had said your Marriage is getting affected instead of Divorce.
Vrinda (Querist) 10 May 2014
Thank you Arunagiri Sir. Barman and other experts should know that a lawyer has no right to judge a client or a case. He should merely opine. Judging is the job of a judge.

@Mehar Afshan - Have you or Barman seen the photos? I would hv understood if Barman or you requested for them before opining. But here lawyers seem to be in a hurry to score than understand a question. You expect me to look out for people with camera phones in a big party with many ppl in it? Sounds ridiculous.

@Arunagiri and Afshan
My 2 and 3 questions of first post remain unanswered. Law of notices, who has clarified that doubt about getting addresses? Whom are the experts helping here? Their egos and scorecards?
Unhealthy situation? Tell that Barman to talk law not act like a psychologist counselling someone. Quantity of replies here is as high as the number of lawyers, what's lacking is quality. My lawyer says many lawyers complete law at 50, does not mean they are experienced in law. None of you could state specific acts or notice procedures to get addresses. So, I got very little help here and only from Dhingra Sir and Arunagiri and I wish to thank them both.

I have hired a reputed senior advocate and handed the matter to him and so this topic will be marked resolved.

you delete the same on your fb account and time line deletes automatically, you say only you, then none can see you why waste time on fb.

if you do not have time why post your photos, everything emanates from your end only is it not so you are arbiter!
