(Querist) 27 March 2015 This query is : Resolved
RESPECTED SIR,

IN MY 138 CASE
ACCUSE ADVOCATE IS TAKING DATES AND NOT FINISH THE CROSS MORE THAN 6 MONTHS PASS AWAY.

CAN YOU PLEASE HELP ME WITH THE JUDGEMENT THAT ACCUSE ADVOCATE CAN NOT TAKE ANY DATE AND FINISH THE CROSS.

THANK YOU
Advocate M.Bhadra (Expert) 27 March 2015
File a petition in the same court for speedy disposal of the case, failing which you can file a Revision Petition in High Court under article 227 of the Indian Constitution for expedite order upon the lower court.

How many opportunities have been availed/ granted by the court for completing defence evidence?
Did you/your lawyer oppose further opportunity?
Has the accused been granted permission to depose for himself?
Whether you are satisfied with the performance of your lawyer? If yes, what for did you post this query? If no, change him/her immediately.

Your lawyer should oppose if time and again the next date is asked by the opponent.

Such cases generally take 3-5 years in decision.

It depends on how your advocate is putting pressure on the court against the delaying tactics adopted by the other side. You may pressurise your advocate to put pressure before court on this issue.
