Can i get seized documents from vigilance through rti

Vigilance officials seized some office documents at the time of trapping. Can I get certified copies of those documents through RTI? kindly advice

Vigilance department is not bound to provide the certified copies of those documents prior to the completion of enquiry by way of RTI.

If the doucments were siezed from your possession you may apply for an attested copy and get it.

Dear Gopinath,

Charge sheet may be in the offing, if documents have been siezed by the vigilance. You may wait that patiently for the time being. After the charge sheet is served, some of the documents would find place in the listed documents based on which the charge would framed. Copies of those documents would compulsorily be provided to you at the beginning of the inquiry proceedings after set up of a departmental inquiry for the purpose of making your defence strategy and to cross-examine the departmental witnesses on your own points to counter the charge. Out of the rest of the document, you would be rightfully entitled to call your choice documents, as additional documents for the purpose of your defence in the inquiry proceedings.

However, if before issue of a charge sheet or even otherwise, the vigilance asks you to give any statement, you may insist on examination of the documents before making any statement. The cannot compel you to make any statement without verification of the facts from the records siezed by them. But be cautious not to make any statement without verification of the official records.

I fully agree and appreciate the stretagy as advised by expert Sh. PS Dhingra ji.

Just wait for the charge sheet and you will definetely get most of the documents required; especially wherein CBI has relied upon to prove the offence/ allegation against you.
