Appeal for interim order in dv

(Querist) 17 July 2014 This query is : Resolved
Hi Experts,

It seems that my appeal against interim order in Domestic Violence will be not accepted / rejected as my lawyer was not prepared during argument.

Please tell me what next I should do against Sessions court order.

1. Can I go for DV quash in high court order.

2. Can I appeal again in Sessions court.

Thanks in advance

Hc is generally reluctant to quash DV cases . fight case on merits before trial court
Rahul Mendiratta (Querist) 17 July 2014
If HC is reluctant then what is the way out to stop interim maintenance awarded by trail court.

How can I get stay?
ajay sethi (Expert) 18 July 2014
pay the interim maintenance awarded by trial court .
Rahul Mendiratta (Querist) 18 July 2014
Does not seem to be a good option.

Dear Rahul
when the appeal filed before session court dismissed then file a revision or writ against this order with the interim application for stay the proceeding of trial court along with the execution proceedings.
second appeal is not maintainable.

Thank you sir
Rahul Mendiratta (Querist) 23 July 2014
Nadeem sir, I think you are suggesting to file a revision in high court.
Please confirm.
What are the chances in high court for this revision or writ accepted.
What could be grounds?

Thanks in advance
