Delay in submitting chargesheet to court

Querist : Anonymous (Querist) 30 July 2016 This query is : Resolved 
I have filed a FIR under section 498a, 323,3/4 DP act against my husband and inlaws. Chargesheet has been filed by police in march 2016.but yet has not submitted to court. Kindly tell whether we should insist to submit chargesheet to court or not. Whetherwe can go in high court at this stage, to assure so that the accused would not get bail.whether police can alter the chargesheet before it has submitted to court.

You can approach to the inspector of police or higher authority and request him to file the charge sheet as soon as possible, OR file a writ petition in the high court against the police.

Chargesheet : The minimum period is 90 days and there is no limit for maximum period, the circumstances it depends upon.

Sir you have mentioned chargesheet filed .but where? Kindly note that police should file chargesheet in 90 days in court after f.i.r.if not filed accused if in jail may get bail.you may file writ petition at high court to expediate same.good luck

If charge sheet not filed in the court, either wait for the same or approach higher police officials.

If charge sheet prepared and not submitted in the court, police can make changes before submitting it in court.

Once charges under 498a,323 and 3/4 are finalised in chargesheet. Then whether police can alter the chargesheet before submitting it to court. Actually it has been told to me by police in an online complaint that chargseet under above charges has been filed against all the accused in march 2016. But till now it has not been received in court. What should i do??

You may ascertain the factual position under RTI from the Police or from the Court through an advocate.
