Dear Sirs,
I am placed at ANDHERI, Mumbai. Our Society is under Redevelopment process.
I HAD TAKEN LOAN FOR PURCHASE OF MY FLAT. I HAVE SINCE REPAID THE LOAN AND HAVE GOT NO DUES CERTIFICATE FROM MY BANKER. BUT, MY BANKER HAS NOT YET GIVEN BACK MY ORIGINAL SALE DEED WHICH WAS
MORTGAGED. IT WILL TAKE SOME TIME IT APPEARS SINCE DOCUMENTS HAVE TO COME FROM HEAD OFFICE.
Please guide me, if the Original Sale Deed would be required or Only Share Certificate (in my name) in
Original which is available with me is enough for TRIPARTITE AGREEMRENT (Permanent Alternative
Accomodation Agreement)?

If loan is repaid then insist for original documents fast.
It would now depend on society as to insist for original or not. Generally they do not insist for it.

Society will grant time to produce Ori Agreement from Bank

it takes around 21 days to obtain original documents from bank on repayment of loan . society will grant you time

Society should not ask for original as they must be having copy of these already compared by them with originals. If they ask request them to produce after some time. Meanwhile follow up with the Bank to return the original documents.

Yes, I agree with the views of expert Mr.Rajendra K Goyal that the society will be having the compared photocopies of the land deed, even otherwise, the society will grant time to produce the original since the bankers take time to return the same after completing all other related formalities.

I do not foresee any problem when Share Cert is with u n letter is recd that dues are fully paid n Org agreement is being returned. Give undertaking that org Agrent will be submitted on rcd. They must execute tripartite agreement for alternate accommodation.
