Section : Retrial of certain appeals relating to public suits.

4. Retrial of certain appeals relating to public suits.-Where, inany appeal arising from a suit relating to any such public matter, adecree has been passed after the 30th day of November, 1931, andbefore the commencement of this Act, dismissing the appeal ordismissing the suit from which the appeal arose, solely---------------------------------------------------------------------1 Subs. by the Adaptation of Laws (No. 3) Order, 1956, for "Part A States and Part C States".556on the ground that the previous sanction of the State Government inrespect of the suit had not been obtained as required by section 93 ofthe Code of Civil Procedure, 1908 (5 of 1908), the Appellate Courtshall, on application made within six months from the commencement ofthis Act, make an order setting aside its decree and shall proceedwith the appeal.
