Section : Giving or fabricating false evidence with intent to procure convictionof capital offence;If innocent person be thereby convicted and executed.

194. Giving or fabricating false evidence with intent to procureconviction of capital offence.--Whoever gives or fabricates falseevidence, intending thereby to cause, or knowing it to be likely thathe will thereby cause, any person to be convicted of an offence whichis capital 2*[by the laws for the time being in force in 3*[India]]shall be punished with 4*[imprisonment for life], or with rigorousimprisonment for a term which may extend to ten years, and shall alsobe liable to fine; If innocent person be thereby conviceted and executed.--and if aninnocent person be convicted and executed in consequence of such falseevidence, the person who gives such false evidence shall be punishedeither with death or the punishment hereinbefore described.
