The Supreme Court has dismissed the petition by a Chennai-based rights activist demanding action against the advocates whose protests turned violent in the Madras High Court premises in February this year.



‘How can we give such a direction? You go to the Bar Council of Tamil Nadu,’ a Bench comprising Chief Justice K G Balakrishnan and Justices P Sathasivam and B S Chauhan told the petitioner Vishwanath Swamy yesterday.



Without making any further plea, senior Counsel Soli J Sorabjee appearing for the petitioner, withdrew the Public Interest Litigation (PIL).



The petitioner had alleged that there were several criminal cases pending against some of the protesting advocates since 2001 and that the State Bar Council had failed to take action against them.



‘As far as Bar Council of Tamil Nadu is concerned, in spite of being aware of misconduct by a group of advocates within the High Court premises on several occasions, no action was ever taken against the erring advocates since 2001. It is obvious that the Bar Council has given tacit support for violence against the lawlessness and misconduct,’ Mr Swamy claimed in the petition seeking the intervention of the apex court in the matter.



The petitioner also sought the transfer of all cases relating to the February 19 incident out of Tamil Nadu ‘in the interest of free and fair dispensation of justice.’
