Delhi HC Refuses To Stay DDA Flat Allotment Dated:18-02-2009 Source: UNI DELHI : The Delhi High Court dismissed a petition seeking stay on allotment of flats by the Delhi Development Authority on allegations of large scale irregularities in the draw of lots. A Bench comprising Chief Justice A P Shah and Justice Sanjeev Khanna refused to stay the allotment of flats under the DDA’s recent draw which drew lot of criticism for the alleged fraud by property dealers in consensus with some DDA officials. Petitioner Prem Chand had alleged that the DDA had illegally allowed applicants under the Scheduled Tribe (ST) category from other states to participate in the draw and sought an immediate stay from the court on the allotment of flats till the completion of investigation into the alleged irregularities. According to the petitioner, under the DDA Act the housing authority is not entitled to accept the applications filed by the people who are residents of states other than Delhi. In its reply to the court, the DDA refuted the allegations and said the DDA scheme is open to people of all states for all categories and is not only for the residents of the capital. In December last year, the DDA held the draw for allotment of 5000 flats under the housing scheme but later a complaint was registered claiming irregularities in the draw. The Economic Offences Wing of Delhi Police’s Crime Branch is probing the matter and has arrested seven persons, including Laxmi Narayan Meena -- a former SBI employee and a resident of Rajasthan’s Jhunjhunu till now. DDA is also conducting an in house inquiry to establish the irregularities at their end.
