Allahabad HC Directs CMO Kushambi To Appear In Court Dated: 19-02-2009 Source : UNI Lakhnow : TEXT: Taking a serious note of submitting an unfair and erroneous opinion in a criminal case, the Allahabad High Court directed the members of Medical Board, including Dr D R Verma, CMO Kaushambi, to appear before the Court on February 26 and explain as to how they have given the said opinion. As per the facts of the case the petitioner Savita Devi claimed that she had a fire arm injury for which she was medically examined and papers were handled over to the police but police of P S Sarai Aquil only registered an NCR (Non cognizable report) under section 323, 504, IPC. Perplexed by this, she moved an application before the magistrate seeking direction to investigate the case, on which IO constituted a medical board which gave its opinion that the inquiry was self inflicted by the woman. A bench comprising Justices Amar Saran and R N Mishra, however, was of the view that when in earlier medical report dated July 2, 2008, a lacerated wound was found and X-ray showed two small rounded shadows of metallic densities over the skull vault on the frontal bone of skull. How come the board reached a positive opinion that so called fire arm injury was not due to fire arm or that the injured woman had self inflicted the said injury on her forehead. The Court has fixed February 26, 2009 for appearance of doctors. The medical board comprised Dr Rajesh Chaddha, Dr Manu Gopal, Dr B L Jaisawal and Dr D R Verma (CMO) Kaushambi, which found that the scar mark was a result of a lacerated wound on head and as there was no injury on the rest of the body, the board inferred that that no fire arm injury at all was received by the woman.
