Kerala HC: Observations Should Not Deter Sr Abhaya Case Probe 1/7/2009 The Kerala High Court made it clear the observations made by single bench Judge, Justice K Hema, while granting bail to the three accused in the Sister Abhaya Murder Case would not deter investigation into the case. Single Bench Judge Justice, Mr R Basant, also orally observed that there were inconsistencies in the observations regarding narco-analysis CDs and reports, conducted on the accused, by Mr Justice Ramkumar and Ms Justice Hema. Mr Justice Ramkumar, in his order on September 4, 2008, praised the FSL Lab, Bangalore for doing a commendable job in the narco-analysis test on the three accused --Father Thomas Kottur, Father Jose Puthrukkayil and Sister Sephi --. But Ms Justice Hema, in January 1 order, observed the CDs were tampered with by the lab. Ms Justice Basant said these two statements were contradictory, while considering a petition filed by the CBI seeking clarification whether the agency should continue with the investigation or wait for further orders. The court had also made it clear the observations in a bail order was only regarding granting bail and would not affect the investigation. Meanwhile, the CBI informed the court that they will restart the investigation in the light of these observations. Mr Justice Basant reserved the CBI petition for further orders on Thursday. UNI
