Karnataka High Court has upheld the action of Assembly Speaker K G Boppaiah disqualifying 11 BJP MLAs for anti party activities. The third judge - Justice Sabhahit - pronouncing the Judgement said he concurs with the view held by Chief Justice J S Khehar that the disqualified MLAs have acted against the party by submitting to the Governor the letter of withdrawal of support to the Government.

The two judge bench of Chief Justice J S Khehar and Justice N Kumar had earlier held divergent view and the case transferred to the third Judge Justice V G Sabhahit.

The writ petition was filed in the Karnataka High court when Speaker K G Bopaiah had ordered disqualification of 11 BJP and five Independents on October 10 on the eve of the first floor test faced by B S Yeddyurappa. The case pertaining to five Independent MLAs is listed before the new bench of the High Court on November 2.
