OVERVIEW
A petition has been filed in the Delhi High Court seeking directives to the Centre and Delhi Police for the evacuation of people sitting in the protest of the farm bill and clear the public spaces.
The plea has been filed by Dhananjai Jain, represented by Advocate Bhoop Singh, has also sought for the removal of Delhi Police Commissioner S.N. Srivastava and to penalise police officers who failed to discharge their duty.
PLEA MADE IN THE PETITION
The case claims to display 'complete failure of the government', and especially that of Delhi Police in maintain law & order efficiently and keeping a check on miscreants.
The plea also mentions that the armed police of Delhi failed to perform its duty to 'keep its honour by protecting the token of sovereignty.'
“…any agitation has to be on democratic and civilised lines as per rights guaranteed under the Constitution and can under no circumstances take to violence which has been witnessed in an unprecedented manner in the capital city of Delhi.”
“Republic Day, a day of national pride, was turned into shameful day in the independent India that a group of protesters were allowed to approach the Red Forth and hoist their own flag and hit the icon of sovereignty while showing disrespect to the national flag.”
The matter was put forth a division bench of Chief Justice D.N. Patel and Justice Jyoti Singh for hearing on February 16.
The petition also insisted on deployment of adequate para-military forces to protect important monuments and to ensure safety of life and property of the people of Delhi and regain their confidence and sense of security.
CONCLUSION
The famers' protests have been going on since November 2020 and farmers have been agitated regarding the three amendments in the farm bill. Hopefully, the Delhi High Court will pass an insightful verdict that upholds the fundamental and democratic provisions in the Indian Constitution.
