SC asks State governments to pay loss on disruption of service during Agitation

The Supreme Court has asked the state governments to pay for the loss incurred to Railways and the general public on disruption of rail services during agitation. A bench of Justices G S Singhvi and A K Ganguly said, destruction of public property and disrupting train services cannot be allowed in the name of agitation.


The bench asked the Haryana government to respond why it should not pay the loss incurred by the Railways following the 11-day stir organised by 12 'khap' panchayats against booking of some upper caste people in connection with the Mirchpur dalit killings case.

In India the agitations, started in the name of democratic way of protest, are often taking ugly turns. They should be done peacefully and without any violence. If they turn violent, destroying public property the organizers, whether they are the political parties or government agents, should bear the loss caused by the agitators.

Bandh whether legal/illegal sponsored by or not sponsored by the State, if public property is destroyed the persons involved in it should be punished sternly; at the same the State Govt should be made responsible to make good the public/private property lost due to agitation. The Apex Court has taken a right decision; it should also issue mandates to Central Government to enact laws to deter destruction of public/private properties by agitators. Concerned State Govts should be made responsible to ensure that those persons or political parties/leaders involved in destructive activities are severely punished to deter this trend.

Excellent. Why should I pay for loss of services/revenue due to such agitation. There are non disruptive ways to protest. Elected representatives are supposed to air the grievances of the electorate. If the right to agitate is a fundamental right then so is my right to carry on with my business/travel etc a right of mine. No one has the right to disrupt without ensuring his duty of not disturbing others.

Agitation could surely be right of citizens against state but there is a greater right which vest in the citizens of India to save their right from being hampered. If any Govt. is unable to protect the same then should be liable to compensate to restore the position of rights.

state can be asked to pay compensation if the agitation was sponsored directly or indirectly by the State government. for eg. a bandh orgainsed by the ruling party. it is to be noted that bandhs are declared illegal by the kerala high court long back.

The view of the Judges of Hon'ble Apex Court in the matter is not proper . If state government will pay loss to the railways then in future , state government will surly voilate the fundmental rights of a Citizen using the force. Agitation is the right of people to draw attention of the government on their demands.Other Hand , it is also the resposnsibility and duty of a citizen to safe the national property and not to perform such type of activities which could creat problems for others.
