Age-Limit for Senior Citizens Facilities

The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 defines ‘Senior Citizen’ as a person who has attained the age of 60 years or above. The Act provides for claim for maintenance allowance; geriatric and health care; shelter and protection of life and property.


The Act comes into force upon notification by individual State Governments. 22 States and all Union Territories have notified the Act so far. The Act is not applicable to the State of Jammu & Kashmir. The remaining 5 States have already been requested to notify the Act. 


This information was given by Shri. D. Napoleon, the Minister of State for Social Justice & Empowerment, in a written reply to a question in the Lok Sabha today.

Decision makers should view in the common man's angle of view, as bread-winners for their family, in general sense. Seniors (veterans), with their vast rich experience, in their line of experience turn as Consultants, during their old age earning or (honorary) non-earning service, depending on the individual. To be noted that Post retirement staff engaged generally from the bureaucrats and ex-judges, who are the decision-makers,not under-standing the sentiments of the lower strata of the society. No where such discrimination amongst senior citizen persists, unconstitutional as well.

While courts consider 65 yrs for the senior citizen. Courts should define as to how and why arrived 65 yrs., when the Railways and the majority of the departments consider as 60 years. Though equality enshrined in our Indian Constitution. Is this democracy?

This is what should be. Only the person who approaches the 60 knows the pains of age which are not at all experienced by the younger.

Relating age limit with retirement age in govt service is illogical, since all who are 60 and above are not retired govt. servants, and this number is quite large in comparison to people retiring from govt. service and a majority of them are from labour class whose ability to carry physical work has diminished with age.

People generally lose earning capacity due to various physical and mental constraints above 60 years. The age limit of 65 as per income tax rules should be relaxed to 60 years.

60 years is the most appropriate age for declaring senior citizen status. When a person stops earning on his own he becomes dependent on others. Hence the society/ government should help him in managing his affairs by granting the concessions of the senior citizen. The uniformity of law ensures rule of law. All departments should accept 60 years as a age limit for senior citizens.

its good but as in most of the government departments the retirement age is about 60 years so in my opinion the senior citizen age determined by the F.M. in Income Tax Act as 65 years is correct and in all the acts it should be 65 years and not 60 years as no one becomes too old as soon as he or she retires.

It is unfortunate that we are in the era of confusion in every field without worrying about common man. The age of senior citizen is also like this and retirement age. We have no uniform policy in any such matters. Being a lawyer I am unable to convince clients the rationale behind these matters and due to non uniform policies and have found no logic while enacting/amending laws.
