SC: No Retrospective Effect For 2010 Amendment Enhancing Gratuity Upper Limit As 10 Lakh Rupees

The Supreme Court has observed that 2010 amendment of Payment of Gratuity Act 1972 is not retrospective. The decision was given by Justice Hemant Gupta and Justice A S Bopanna. The case was of Krishna Gopal Tiwary v. Union of India. The appeals were dismissed. The Bench held that the benefit of higher gratuity is available once to the employees only after the commencement of the Amending Act.

Bombay High Court Reserves Order On I T Rules, 2021

The Court was hearing the writ petitions filed by AGIJ Promotion Of Nineteenonea Media Pvt. Ltd., the company that owns the legal news portal 'The Leaflet’ and a PIL filed by journalist Nikhil Wagle for interim reliefs, to stay the IT Rules 2021. The decision was given by a Division Bench of Justice G S Kulkarni and Chief Justice Dipankar Dutta. The order on the pleas is currently reserved.

Law Students Approach SC Seeking Gender Neutral Provisions For Sexual Offences

A petition has been filed in the Apex Court pleading that the provisions in the Indian Penal Code regarding sexual offences need reconsideration and need to be amended to make it more gender neutral. The tagline of ‘Men’s Lives Matter’ has also been raised. It has been contended that the laws and provisions are discriminatory on the grounds of gender and hence violate the Fundamental Rights.

Madhya Pradesh Higher Judicial Services Rules, 2017 Have No Retrospective Operation

The Supreme Court has observed that the Madhya Pradesh Higher Judicial Services Rules, 2017, have no retrospective operation. The Bench that gave the decision consisted of Justice L Nageswara Rao and Justice Aniruddha Bose. It was held that the roster would be prepared only after the commencement of the said Rules and the seniority inter-se of the direct recruits would be determined on the basis of the roster.

SEBI Bars 15 Entities For Insider Trading In Zee Entertainment Stocks

An interim order was passed by the Securities and Exchange Board of India (SEBI) which barred 15 entities from dealing in securities as prima facie evidence has found them guilty of insider trading in Zee Entertainment stocks. It was also found that by executing trades while in possession of UPSI from the trading accounts of their connected entities, the noticees prime facie violated the provisions of the SEBI Act and the PIT Regulations.

Karnataka HC: erecting Statue Of Dr. B R Ambedkar Illegally On Public Property Is Disrespectful

A statue of Dr. Babasaheb Ambedkar was erected on a public land illegally by a youth association. The said association was given an undertaking to the Karnataka High Court to shift the statue to another place within 4 months. The undertaking was given by Revana Siddappa, President of Dr B R Ambedkar Youth Association,to the Division Bench consisting of Justice Abhay Sreeniwas Oka and Justice N S Sanjay Gowda. The Court said that erecting an incomplete statue was disrespectful.
