Justice R F Nariman Retires As A Supreme Court Judge

Justice Rohinton Nariman retired as a Supreme Court judge. He also shared the Bench with the Chief Justice of India, CJI N V Ramana, as per customs. He was the fifth counsel to be directly elevated to the SC Bench. As a SC judge, he has disposed of nearly 13565 cases and given landmark judgements like the Shreya Singhal case and the K S Puttaswamy case. He was the first counsel to be briefed by Solicitor General Tushar Mehta.

What do you think about this case?

Supreme Court: Right To Shelter Does Not Mean Right To Government Accommodation

The case was of Union of India V. Onkar Nath Dhar. The decision was given by Justice Hemant Gupta and Justice A S Bopanna. It was observed by the Bench that right to shelter does not mean right to government accommodation. The order of the Punjab and Haryana High Court was set aside. Government accommodation was meant for government employees and serving officers, and not retirees, as stated by the Court.

Kerala HC Refuses To Quash Criminal Cases Against Archbishop George Alenchery

The decision was given by Justice P Somarajan. The Kerala High Court has dismissed the petitions filed by Cardinal Mar George Alenchery, the Major Archbishop of the Syro-Malabar Church. The petitions filed sought to quash the criminal cases of the properties of the Syro-Malabar Church. The petitioner had executed numerous sale deeds unilaterally. The Bench held that there was a clear breach of trust on behalf of the petitioner.

What do you think about this case?

SC: Family Court Cannot Try Criminal Cases Under IPC

The prayer sought to transfer a criminal case registered under various provisions of the Indian Penal Code (including under Section 498-A IPC) from the Judicial Magistrate Court, Thane, Maharashtra to the Family Court, Vadodara, Gujarat. The transfer petition was initially allowed; however, the Court modified the previous decision and held that the family courts are not allowed to deal with criminal complaints of offences listed under the IPC.

Kerala High Court: ED Entitled To Maintain Writ Petition Against State Government

The decision was given by Justice P B Suresh Kumar. The case was of Enforcement Directorate V. State of Kerala & Ors. The Court observed that the ED was a department of the Central Government and hence cannot file a writ petition as it is not a juristic person which can sue and be sued. This order was challenged by the ED. The Kerala High Court on Wednesday held that the Enforcement Directorate can prefer a writ petition against the State Government despite being a statutory body since its Officers were empowered to exercise powers under the Prevention of Money Laundering Act.

Allahabad High Court's Quashes NSA Detention Related To Cutting Beef In Secrecy

The case was of Parvez through His Brother Imran (Respondent) V. State of U.P. through Secy. Home Lucknow & Ors. The Court ruled that cow slaughter during the early hours of the day due to poverty, unemployment or hunger would only amount to a law and order issue. Since it took place away from the view of the public, it cannot be said to a matter of public order. The decision was given by Justice Ramesh Sinha and Justice Saroj Yadav.

Delhi HC: SDM Issuing Notices At Residence Of Couple Seeking Registration Under Special Marriage Act Is An Act Of Contempt

The Delhi High Court has observed that the act of a Sub Divisional Magistrate (SDM) to issue notices at the residence of a couple seeking registration of marriage under the Special Marriage Act is prima facie contempt of court. The decision was given by Justice Najmi Waziri. The case was of Parveen Bano and Anr. V. Chandra Shekhar, SDM, South West Delhi. The matter has been posted for hearing on September 8.
