Amendment to Labour Laws

The Union Labour & Employment Minister Shri Mallikarjun Kharge has informed the Lok Sabha that amendment/review of labour laws is a continuous process in order to bring them in tune with the emerging needs of the economy including to accelerate industrial growth in the country.

Recent amendments carried out include those under the Payment of Wages Act, 1936, the Payment of Bonus Act, 1965, the Apprentices Act, 1961, the Payment of Gratuity Act, 1972, the Employees’ State Insurance Act, 1948, the Industrial Disputes Act, 1947, the Plantation Labour Act, 1951, the Maternity Benefit Act, 1961 and the Workmen’s Compensation Act, 1923. In addition, the Government introduced in the Parliament Labour Laws (Exemption from Furnishing Returns and Maintaining of Registers by Certain Establishments) (Amendment) Bill, 2011, the Mines (Amendment) Bill, 2011 and the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) (Amendment) Bill, 2011.

 

The Minister was replying to a written question whether the Government has any proposal to amend the existing labour laws so as to accelerate industrial growth in the country; and the steps taken/proposed to be taken in this regard.

Amendments are half hearted efforts of the Governments. If the Acts are implemented properly there may not be any requirement for additions or alterations of the labour laws The implementing machinery has become corrupt thereby making managements to survive with whatever unfair practice. If looked at from the point of view of managements, they silently suffer the extortion to run the industry. If there is honesty and integrity the problems may not arise.

tHE ENTREPRENUER FINDS WAYS AND MEANS TO REMAIN OUTSIDE THE AMBIT OF LAWS AND THE LABOUR ENFORCEMENT MACHINERY IS DELIBERATELY MADE TO BE WEAK.THE ENTREPRENUERS MAKE HEFTY PROFITS AND SAY THEY ARE AN NGO OR ELSE THAT THEY ARE DOING CHARITY AND NOT BUSINESS

I fully agree with r k mishra as well as suni jee.the entrepreneur finds ways and means to skip out of the legal provisions. The labour enforcement machinery is made to be so weak that they cant do much and they have to flow with time and other environmental factors in the society and the entrepreneurs make hefty profits in the name of charity and NGO.

Instead of good Labor Laws, Workmen are being exploited. One of the reason is the selected (NOT elected)Union leaders by their Political masters. Amendments should focus on this matter.

Govt should bring all NGOs partnership firms,proprietorship firms most of the partnership ,proprietorship as well as pvt ltd company also pay very less salary and they take more than 8 hours work from employees even they are not providing any medical facility or ESI facility to his employee. i have seen most the company situated in Delhi they are violating the labour law.

yes it is good to amend certain laws related to labour. Government should bring NGO's also under all the labour law provisions, most of the NGO's has employees but there are paid less by the management by saying or showing charity work.
