CBI court's no to Talwar's bail plea; he moves sessions court

Ghaziabad, June 10 (PTI) The bail application of doctor Rajesh Talwar, prime suspect in the Noida twin murder case, was dismissed by a CBI court today saying it was not empowered to take up the matter. Minutes later, Talwar's counsel Satish Tamta moved a fresh application in the Ghaziabad District and Sessions court, which posted the matter for hearing on June 26. Earlier, Special Magistrate for CBI cases Swapna Mishra Tripathy observed that the Sessions Court was competent to take up the bail application of Talwar, who is at present in judicial custody, as he had been charged with sections 302 (murder) and 201 (destruction of evidence) of the IPC. Talwar was arrested on May 23 by the Noida Police who claimed that he had murdered his daughter Aarushi and domestic help Hemraj after allegedly finding them in an "objectionable position" on the intervening night of May 15 and 16. The Noida Police started the probe into the double murder but soon faced allegations of improper investigation. Following this, the case was transferred to the CBI which began its probe on June one. The CBI also questioned Talwar after taking him on remand. Immediately after his bail plea was rejected by the special magistrate, Talwar's counsel moved the court of District and Sessions Judge Narendra Kumar Jain with a bail plea stating that his client was "innocent". The court posted the matter for June 26. The counsel sought bail for Talwar on humanitarian grounds stating that his client had met with a major tragedy - his daughter's death. It was also submitted that Talwar had never tried to destroy any evidence or even attempt to do so in future. PTI
