A co-accused cannot oppose the bail of another co-accused, Delhi High Court has said. "The opposition to the bail by a co-accused who is in the capacity of an accomplice and hence himself is a discredited man cannot be permitted,'' the HC said while dismissing the plea of an accused to be an intervener in the case of a co-accused. Two friends who allegedly cheated a man of nearly Rs 4 crore are at loggerheads with one opposing the bail plea of other. Accused Sachin Saraf and Pramod Bihani were booked by the economic offence wing last year after they allegedly cheated Satish Kumar and his company of Rs 3.90 crore. Things turned bitter between both the accused after Sachin settled the matter with complainant Satish Kumar and sought bail from the HC. But Pramod filed a plea in HC, saying that Sachin was a relative a director employed at the company of complainant and the settlement was a ploy to implicate him. Justice V K Shali, however, was not impressed by the contentions of Pramod and said, "No doubt the Supreme court has over the years relaxed the concept of the locus standi even in criminal cases but that does not give a carte blanche to complainant or any other person to come and join any proceeding at will.'' Rejecting Pramod's plea, justice Shali said, "If permitted... it will result in multiplicity of litigation and such applications would also result in side tracking the focus of the court from the main issue.''
