Working persons in apartmrnts

Respected Peers,

In our Apartments in Kerala (Association regd.under Society Registration Act 1860) the association now take over the management from the builder. And we wished to keep the existing 4 workers (2 securities from agency and one care Taker and host keeping lady directly).

What sort of formalities we required with these workers in our apartment. We have not yet done any written contracts with them but just continuing their service. 

Whether such contracts in written doc required? Whether the min wages and other benefits etc. are applicable for these workers also? What sort of legal formalities or protocols we should do in such scenario?

Please advise.

If you want to hire their services on contractual basis then you can enter into a contract based on their nature of job with clear descripttion of their remuneration and other aspects including the timings etc.

If you are employing them as permanent employees, then you can take them on the rolls of the assocaition as employees of assocaition and can fix their salaries, natrure of work timings and other related issues after discussing the same and by passing a resolution in the MC meeting of the association.

If you are engaving persons through security agency then the agency is expected to have more than 20 employees.  EPFO and ESI dues are chargeable from you.

 

Minimum wages as per state govt notification are must.

you also have to keep buget for bonus each year and gratuity as well.
