Will query - delhi

We are 2 brothers and 1 sister ( all married ) delhi based . My father wants to name the property ( residential house ) in my name through a registered will.

1. If I go for transferring the property under my name in future, What challenges can be faced from other siblings ( even with the registered will ) and how can they be avoided.

If your father executes a Will bequeathing his property to you, no one can claim it. However, because the property is ancestral, you and your siblings have equal rights.

There is no problem in you acquiring the property on he basis of your father's Will, but you can enforce the Will only after your father's lifetime.

However if you apprehend that there may be some problem while enforcing the bequest, from your siblings, you may better request your father to transfer the property by  a registered conditional settlment deed in your favor and the condition is that he will retain life interest in the property and you will automatically become owner after his lifetime

You have to prove will is genuine and lawful in civil Court if any one challenges. Insist your father to gift it.
