Yes, it can even be filed on PoA, depeding upon HC practise, there are precedents from Mumbai/ Delhi/ Karnataka and TN HCs. Not sure about other HCs.

You may have to do the following discreet to make sure you are on firm ground

  • Collect evidence (not simple photographs together), prefarably the evidence of staying together, joint bank accounts etc and including certificates 
  • Collect evidence with regards for wilful desertion 
  • Try to discuss with her parents and friends who may help you with some information that shall be useful for you
  • When you are sure that she deserted you to be with her boy friend and when you have strong evidence of desertion and evidence of the act of adultery, you may prefer to discuss with her for amicable settlement
  • If the amicable settlement fails and if you are fully aware of your charges, then go ahead and file the petition for restitution of conjugal rights
  • If she doesnt come within 12 months and prefers her way, then divorce shall be easy for you

                                     I have handled the same case.In your case you do not pay any attention to her intimidation..Urgently prosecute her paramoour firstly under ipc497 because  you definately have some evidence about their affair So you can get divorce from the court under mental crielty and adultery of the wife.Take some brave step urgently.,That bl**dy boy friend will also face punishment of 5 years in prison.
