Which deed must be worked out ?

Hello All,

My grandfather died without a will 30 yrs back and left his land and house to his two sons. Now that we want to divide the property amongst oursleves which deed must be worked out. There are some issues. First of all the property is not registered, only Patta that was registered under grandfathers name was transferred in the names of my father and fathers younger brother. 

1. What must the sequence of steps to be performed so that in the event of death of my father there will be no disputes. 

2. To avail bank loan for me to construct a house in this vacant land what documents does my name need to appear in ?

3. Can a gift deed work in this scenario ?

4. Please correct me if I was wrong, my mother and myself have equal rights in this ancestral property and any sale needs our consent to be signed on paper.
