Incomlete and vague facts. Entire case file has to be perused before forming an opinion and oblige by experts on this platform as none of the same can be presumed.

Contact and consult your lawyer who is well aware about facts and circumstances of the case, an able, competent, intelligent enough and duty bound to satisfy your queries/ questions.

You have furnished part information only which actually makes no sense because the background of the case is not known neither the plaint pleadigs nor the prayer sought is known. Therefore you may better discuss with your own advocate on all such further issues or you can consult an experienced lawyer in the local with all the papers and get the subject matter clarified properly instead of getting misguiding information from public forums like this especially when you are furnishing only part information without any relevance to your question.

No opinion could be formed unless the JUdgment is read as a whole. What is the Case No.? Which court?
