I had an inquiry ...wanted to know when does a marriage gets invalidated ?
Is it when ...
1) Either of the people remarries ? but in that case the second marriage can be made void rite !!
2) If there is no physical proximity for more then 1-2yr?
If there is no connection each other that is no contact through any mode of communication ?and if this is now a genral fact with people in the local community.but the court is not informed ?
Then how should one dissolve the marriage thats not funtional for 2-3yrs.since there is a lot of dissonance between the two families !
Please also tell about the status of child that would be involved(which stays with the mother) and if any matainance or divorce case that can come up during the process of invalidation.That is if there is any such process !
Is it advisable for husband to file the divorce petition first or he should wait for his wife to file it first in order to minimize the amount of ailimony and maintanance etc. But since this is a tedious process. what should be done best to end the marriage as non of the parties are appling for mutaldivorce neither ready to live together !!
