Unregistered Agreements Cancellation

Sir entered into unregistered sell agreement during 2018 by mentioning advance amount of rs 1 lakh by cheque. whereas the cheque was returned due to No fund. Is the agreement cancelled Automatically as the advance money not received as cheque issued to me was Bounced. Or i need to take furtger any action for cancellation of agreement

Hello,

As a precaution you have to take legal action against the buyer. Send him legal notice for cancellation of agreement and later file suit in the civil court.

Yes, You have to intimate buyer by sending a legal notice for cancellation/termination of agreement on ground of cheating ( due to cheque return unpaid ) and also mention therein that now you are free to sell property to anyone.
