In response to your query, I hope this will be useful for you; 

Transfer of ownership if the owner of the vehicle is deceased-

The new owner of the vehicle must fill out Form 31 and submit it to the registering authorities with all of the requested information.
Within three months of gaining actual ownership of the vehicle, the new owner should complete the form for transfer of ownership.
Under Rule 81 of the Central Motor Vehicles Rules, 1989, the new owner of the vehicle must pay the registering authority's charges for the transfer of ownership of the vehicle.

Once you have followed this process the vehicle will officially be yours then you can make a sale or you can let the person who is buying the vehicle follow this process and have the ownership directly transferred to him.

The process of transfer of ownership of vehicle upon the death of the owner was a cumbersome process requiring multiple visits to the registering authority's office. However, the Ministry of Road Transports and Highways, through an amendment to the Central Motor Vehicles Rules, 1989 earlier this year notified procedure pertaining to transfer of ownership.

 

As per the amendment, upon the death of the vehicle owner, the person nominated by the vehicle owner or the person succeeding to the possession of the vehicle, as the case may be, may use the vehicle as if it has been transferred to him. He can continue to use the vehicle for a period of 3 months as if the vehicle has been transferred to him subject to the condition that he must inform the registering authority about the death of actual owner and his personal intention to use the vehicle. This intention must be communicated to the registering authority within 30 days of the demise the owner.

 

Further, the nominee will have to submit the details sought under Form 31and pay the charges levied for transfer of the vehicle under Rule 81 of Central Motor Vehicles Rules, 1989. Further, he must make an application for transfer of ownership in the name of the person succeeding the possession in Form 31.
