One joint complaint was made by two person on 21/7/2002 u/s 406/420/467/468 and police regd case on the basis of this complaint. One more joint complaint made by two person against same accused with same section comes on 25/7/2002. Superintendent of police mark the complaint for enquiry and report. After that no action was taken by police. Police take evidence u/s 161 crpc of both the complainant and file the report u/s 173 crpc on the basis of the first complaint and no reference was made about second complaint and after that court framed charge on the basis of first complaint. Trail starts the complainant of first complaint hostile. Complainant of second complainant also not prove his testimony in court. The court convicted one person on the evidence who have not proved his evidence in court and whose complaint was not regd by police and no reference was made in 173 crpc and no charge was framed on his complaint. My question can proceed trail without regiestration of case in police or court convict any person without registration of case in police or without the report of u/s 173 crpc and without charge.
