Terrace rights

sir, we are three brothers and two of us only are residing in a G + 1 building which was constructed by my father with his own money. we all accepted that two of us will share the building. I wanted to know if the person residing on ground floor will get terrace right or not.

Very right Dr Chandran. Is ground floor tenant / resident/ coowner saying u can't use ground open spaces? To a simple wise and ethical person all common spaces like open ground, terrace,passages, stairs are common and for use of all except terrace can be kept locked ( for safety ) and keys can be given to all for judicious use. And Usgae of common spaces does not give right to sell, ask compansation, etc for such spaces. U will be compansated / can sell only ur premises with 4 walls.

It is not out of place to mention that there is lot of nuisance to ground-floor residents(owners/tenants), road-side dogs cats, goats, cows entry when the common entry gate is left open negligently but for the only discomfort when climbing of stairs to top floor residents. Besides for all type of insects,rats, cats gaining access. Besides affecting privacy for easy peep through the windows by those miscreants parking their 2/4 wheelers and their pollution while the automobile engine is started/running. But usually the residents living on the top floors keep grudging and envying the ground-floor residents, who have easy access to their homes. Ultimately, for small petty things, one has to digest and cooperate with one another(others) in the neighborhood, for a peaceful and conducive living.
